There were 3 cars traveling eastbound on the 401 in excess of 232 kilometers per hour. All three vehicles were stopped and issued summons to appear in court and to answer to the charge of Speeding 232/100. Disclosure, concerning this event, was made available to us and to the representative(s) of the other two drivers involved. Upon reviewing this lengthy package provided to us by the prosecution, it became clear to us that there were certain elements of the offence which the prosecution might have a hard time proving. We subsequently advised our client that we should take this matter to trial, and he agreed. One thing to keep in mind is that we met with the prosecution and they offered to reduce the charge to Speeding 199/100 which would only reduce the total fine payable, including costs, from $1,613.75 to $1,095.25 however it still carries with it 6 demerit points and a 30 day suspension of your drivers licence and a major conviction for insurance purposes which in all likelihood, at the very least, will double your cost for insurance.

We, for obvious reasons rejected the prosecutions offer and proceeded to trial. During the trial and our cross examination of the officer it became clear that the prosecutions case was weak and subsequently the charge was dismissed.  As you could imagine, we were elated. What happened to the other two drivers, you ask? Well their representative(s) accepted the prosecutions offer and they both plead guilty to Speeding 199/100. They both had to pay a fine totaling $1,095.25; their driving privileges were suspended for 30 days and I would hate to think just how much they are paying for car insurance.
