OPTION 1 – Pay the ticket.

By paying the ticket you have just admitted GUILT.

The appropriate number of demerit points will be assessed against your driver’s licence which will remain there for a period of two years from the offence date.

Upon paying the ticket, the Ministry of Transportation of Ontario will be notified of the conviction and they will enter the conviction on your drivers abstract which will remain there for a period of three years from the date you paid your ticket.

When you renew your insurance policy or when your insurance company does their due diligence, this information will be available to them when assessing you and the risk of insuring you.

OPTION 2 – Guilty with an explanation.

Guilty with an explanation means exactly that, GUILTY with an explanation. You are admitting guilt.

Thus, the appropriate number of demerit points will be assessed against your driver’s licence which will remain there for a period of two years from the offence date.

Upon paying the ticket, the Ministry of Transportation of Ontario will be notified of the conviction and they will enter the conviction on your drivers abstract which will remain there for a period of three years from the date you paid your ticket.

When you renew your insurance policy or when your insurance company does their due diligence, this information will be available to them when assessing you and the risk of insuring you.

The only difference between Option 1 and Option 2 is that the Justice of the Peace in intake can reduce the fine.

Note, you will personally have to attend at the Provincial Offences Office indicated on the back of your ticket to exercise option 2.

OPTION 3 – Trial Option.

You have 15 days to file the ticket with the court.

You will receive the Notice of Trial in the mail within 15 to 45 days as will the Prosecutor and the Investigating Police Officer(s).

At trial, the prosecutor will present their case by calling their witnesses. That may include the officer or officers and/or witnesses who are involved in this matter for example if there was an accident the other driver and any persons who witnessed the accident. You will then have an opportunity to question all of the prosecutor’s witnesses. Upon conclusion of the prosecutor’s case you will then have an opportunity to give your side of the story and the prosecutor will then cross examine you. You will then have an opportunity to call your witnesses and they too will be cross examined by the prosecutor. You will then make your closing arguments as will the prosecutor and then the presiding Justice of the Peace will assess the evidence that was presented, apply the appropriate case law and they will make a determination of guilt.

OPTION 4 – Retaining our services to ensure a successful resolution.

We will review the charging documents to ensure everything is in order.
We will file the request for trial with the court.
We will make a written request for full and complete disclosure from the prosecutor’s office.
We will review the disclosure.
We will review the disclosure, with you.
We will meet with the prosecutor to discuss the file.
We will negotiate a resolution with the prosecutor if instructed to do so, by you.
We will prepare a defence to the charge, for trial.
